1. Scope
The following sections provide the Privacy Policy for the Replied website, https://joinReplied.com (the “Website”), and the related Replied platform (the“Platform”), mobile applications (the “App”) operated by Replied Inc. (“Replied”,“Replied App”, “Company”, “We”, “Us” or “Our”, as well as variations of these that are case insensitive). We refer collectively to all these services as the “Platform”. ThePlatform and any features, content, tools, methodologies, and functionality offered on, or through, our Website and the App are collectively referred to as the “Services”. We interchangeably use “Platform” or “Services” to refer to the services provided by us.
For purposes of these Terms, “You”, “you”, “Your” and “your” (as well as variations of these that are case insensitive), means you as the user of the Services or the Platform. If you use the Services or the Platform on behalf of a third party (a company, another individual, another entity, or otherwise) then “you” includes you and that third party, and in such cases you represent and warrant that (a) you are an authorized representative of the third party entity with the authority to bind the entity to these Terms, and (b) you agree to these Terms on the third party’s behalf.
Replied Inc. provides a social media application for exchanging and communicating through video, images, text and other means. To do so, we need to collect information about you, and the protection of your information is a paramount for us. We merely use this information where we have legal basis for such use.
This privacy policy details how your information will be collected and used as well as the steps we put in place to secure your information. Further important and relevant detailsare also provided, such as what choices you have when you use our Platform or Services, the sharing of your information with other third-party affiliates and entities. This policycovers the information that we collect and use in relation to your identified personal information. It does not cover any anonymous information that cannot identify you.
In addition to this privacy policy, you need to read our Terms and Conditions, which details the contractual agreement between you and us when you use our Platform or any of our Services.
2. Your Collected Information
In order for us to enable you to use our Platform and Services, we need to collect some certain personal details about you.
Some of our Services require the creation of user accounts and the authentication of the applicant of this account before these services can be offered. For that, we collect some personal information about you, including, but not limited to, name, gender, age, date of birth, photo, e-mail address, phone number, biography, location, address, country of residency, interests, and social media data. If you register your account using an external sign-on service, such as Apple ID, or Google ID, certain personal information is still collected. In that case, the personal data we collect depends on that external entity, their privacy policy and terms of use, and your own privacy settings with these entities. Other personal information is collected automatically, such as, but not limited to, your IP address, MAC address, your Internet Service Provider (ISP), your mobile carrier, mobile local storage, Cookies identifiers, Pixel Tags/Web Beacons/Clear GIFs, User Session, analytics, Internet-based advertising, your clicks, your viewed pages, joined or viewed groups, posts, duration of activities, as well as information about you collected from other users (i.e. users following or tagging you). We may also collect supplementary information about you from an external entity, a third-party entity, or publicly available information about you from any other sources. We are not responsible for the accuracy of any information that is provided to us by a third party or any other external entities or sources and we are not responsible or liable in whatever shape or form for the policies or practices of such any third party, external entity or sources.
Further, for you to use any of our paid services, or do any purchase with us or through us, we collect information about your bank account, credit card, or other online pay services.
To use our Services, we also collect additional information in relation to your use of our services, including, but not limited to, comments, replies, searches, likes, and groups that you are interested in or part of.
We also collect information about the device you use to access our platform or services, including your mobile device (such as, but not limited to, device ID, vendor, model, OS, configurations, settings, User Session, and other installed applications). Some of this data is used to enhance our Services and to personalize your experience with our Platform and Services.
We also collect some certain personal information about you in relation to your interaction with our Services or Platform, your preferences, your provided feedback about our Services, your interactions with other users, and in cases you participate in any sweepstakes, surveys, or promotions.
We collect additional certain information about you when you apply for employment with us, including but not limited to, qualifications, experience, education, and other relevant information.
Other information, such as, but not limited to, social media contents, replies, blogs, groups, opinions, that you post publicly are considered “public” and it is not subject to privacy protections.
If we have your consent, we also collect information about your contacts, address book, calendar and gallery. We will periodically sync the collected data on our servers with the current information on your device. This information may include, but not limited to, phone numbers, email address and physical addresses. You are responsible for ensuring that the sharing this information with us complies with applicable laws. This may require that you obtain permissions from your contacts to allow such sharing. You have the right to turn off this sharing in your device settings.
We also request your consent to enable and accept Cookies for some of our Services, which result in the collection of various personal data. While you may select not to accept or enable Cookies, our Services do not work while Cookies are disabled due to the lack of industry standard in relation to the interpretation of the communicated data and requests.
3. Use of Your Information
The information we collect from you is used in a variety of ways that allows us to provide you with our Services, to operate our business and to protect you, us and others. These includes, but not limited to: create, manage and use your account, authenticating you, protecting against fraud, enabling access to certain functionality, interacting with other users, maintaining the quality and safety of your devices, enabling customer and technical support, informing you of changes in the Services, informing you for relevant matters or changes that affect your account, processing financial information if necessary, providing services needed for other users as part of our Services or Platform functionality, participating in various activities such as surveys and sweepstakes, improve our Services or Platform, collecting analytical information, collecting information for marketing and advertisements purposes, developing new products and/or features, debugging and feedback retrievals, enforcing compliance with laws, enforcing compliance with our Terms and Conditions, taking necessary actions for legal matters, and for the protection and well-being of you, us or others and for the safeguard of properties that belong to you, us or others, and for security protection against deceptive, malicious or fraudulent or illegal activities. The information is also used in case of restructuring, transfer of assets, restructuring, bankruptcy, or the sale of our company or any part of it or its businesses.

We maintain the personal information we collected from you, and any other supplementary information collected from other external entities, for as long as you are using our Services or Platform. In case of the termination of our services, we may maintain the collected information for a minimum of 180 days following the termination of the Service for law enforcement purposes. We may also retain your information for as long as needed in cases of disputes or in order to resolve a dispute or a legal matter including, but not limited to, establishing a legal defence, conducting audits, investigating suspected or actual illegal activities, or for other legitimate business-related purposes or to comply with applicable laws.
5. Sharing Your Information with Other Entities
We do not sell you personal data*. However, we share your data with other entities as described below.
- Other users of our Services or Platform, which you may be interacting with, or those who may be able to view your public posts and activities. Those other users may access certain information about you including your public profile details, photos, and other information that your settings permit.
- In case you are under the age of majority in your jurisdiction, we will share certain information about you with your parent or legal guardian, who permits you to use our Services or Platform, as per our Terms and Conditions.
- If you access our Services or Platform through third-party entities, such as, but not limited to, third-party Application Programming Interfaces (APIs), Software Development Kits (SDKs), or other third-party technologies that we use to provide our Service and Platform, your information may be shared with these entities. These APIs and SDKs may enable these third-party entities to collect information about you including personal information.
- We may share your information with our advertising affiliates or third-party services that use our Services and Platform for the collection of relevant information for advertising or relevant purposes.
- Other social media applications and platforms that you may use/access through our Services; for instance, posting your profile to a social media platform for employment purposes.
- Service providers that provide services to us for the collection or processing of some information about you.
- Other third-party entities that enable us to collect analytics about your use of our Services or Platform. For instance, we may use Google Analytics to collect behavioral information about your use of our Services. - Other external third-party entities that we engage to administer and provide some services to us in order to run, operate, and maintain our Services.
- Other external third-party entities that we engage for the purpose of providing us with advertising campaigns, online messaging campaigns, or targeted marketing.
- Other external third-party entities that we may use to provide technical and customer support.
- Other external third-party entities that we may use to store your information. The storage of the data may be at any location worldwide, which includes the USA and other countries.
- Other affiliated external third-party entities that we use for payment attribution.
- Other external third-party entities that we may use for payment processing.
- Other external third-party entities that we may use to manage certain activities
such as sweepstakes, competitions, and promotions.
- Other external third-party entities for the purpose of protecting you, us or others,
to comply with national security requests, law enforcement agencies, legal processes, enforcements of legal decisions/judgments, or for the protection of your, our or other’s property, safety and well-being.
- Other external third-party entities that allow us to investigate or assist with the investigation of any suspected or actual illegal activities.
- Other external third-party entities that may allow us to obtain necessary professional services such as law firms, auditors, and accounting firms.
- Other external third-party entities that we need to involve/use in the case we are involved in a merger, asset transfers, sale, restructuring, bankruptcy, or receivership. In such events, your personal information may be shared, transferred or sold* in compliance with applicable laws or/or contracts.
6. Your Information Security
- We take appropriate and serious measures to protect your information. However, and due to many technological shortcomings, there is no 100% guarantee of security. While we have put in place appropriate legal and technical security measures to prevent your data from being accidentally leaked, lost, disclosed, stolen, or manipulated in any unauthorized fashion, and we have rigid and restricted access rights to your data within our Company, employees, and third-party entities, we do not accept liability for any unintentional, fraudulent, or unauthorized disclosure or manipulation of your personal data or information.
- By using our Services and Platform, you release us from any liability whatsoever in relation to such unintentional or fraudulent activities in relation to your information. You understand that we may electronically, or otherwise, communicate with you regarding security, suspicions, security breaches, security updates, and other relevant security measures in relation to the use of our Services and Platform.
7. Your Privacy Rights and Choices
You should be aware of your privacy rights and the choices you have in relation to your personal information. In effect, you have the right to:
- Delete, or correct your personal information. The most efficient and fastest way to do so is through the available Settings on your account. You can alternatively open a service request by contacting us at privacy@joinReplied.com or opening a support ticket at our Platform, when available.
- Request access to your personal information that we hold. You can do so by contacting us at privacy@joinReplied.com
- Request to halt the processing of your personal information for marketing or advertisement, or promotional purposes. You should be aware however that such request may result in some of our Services or Platform functionality becoming inaccessible to you in case this data is necessary to provide such services. - Request that your personal data be transferred to another holding organization if it is technically feasible. If feasible, you accept to carry the expenses and all incurred costs for the transfer and maintenance of the data
- In case you are concerned or dissatisfied with our handling of your data, or you believe that we have not complied with the governing data protection laws, we appreciate you giving us the chance first to correct such matters by contacting us at privacy@joinReplied.com. However, in such cases, you need to be aware that you have the right to submit a direct complaint to the governing regulator in your jurisdiction.
Notes:
- In cases when you contact us with privacy concerns, and the purpose of protecting your own privacy, we may take concrete steps first to verify your identity before fulfilling your request.
- You should take note that only you or someone that is legally authorized to act on your behalf, may make a request in relation to the personal information we collected about you. If you select to designate an authorized agent, we will need first to authenticate and verify that the designation is true and legal. The authorized agent will be required to submit and provide sufficient information that allow us to reasonably ensure the truthfulness of the provided materials and that the agent has indeed been designated as your authorized agent and is legally permitted to act on your behalf.
8. Changes & Updates to this Privacy Policy
The collected personal data is governed by the Privacy Policy that is available and in effect (which is indicated by the Effective Date at the top of this Privacy Policy) at the time the information is collected. The policy however may change or be updated from time to time. We reserve the full and absolute right to modify this Privacy Policy. In case of any material changes, we will take concrete actions to inform you about the changes (through the contact information that we have for you, and/or by placing notices of updates at the front page of the Company’s website or when starting to use the Platform). However, you are solely responsible to review this Privacy Policy from time to time to be informed of any changes. The updated Privacy Policy will be immediately effective as of the time of posting unless an explicit future date where the changes will be effective is indicated. Your continued access or use of the Platform or the Services after the modifications have become effective will be deemed as your acceptance of the updated Privacy Policy and its terms.
